In India, registration is:
- Essential for patents, designs, GIs and plant variety protection,
- Preferable for trademarks and copyrights as registered trademarks and registered copyrights are easier to protect and enforce.
- Not possible to trade secrets.
In India, under the relevant IPR laws, specific civil and criminal penalties may be imposed by a competent court of law on the basis of legal action initiated by the IPR holder concerned.
